The short answer
The Construction Products Regulation (EU) 2024/3110 has applied since 8 January 2026. Product family by product family, the declaration of performance becomes a declaration of performance and conformity. You may provide it electronically (Article 16), including on a website. The product passport for construction products follows through separate acts; no date is set yet.
Regulation (EU) 2024/3110, Art. 16

What changes with the new Regulation
Regulation (EU) 2024/3110 replaces Regulation (EU) No 305/2011 step by step. It entered into force on 7 January 2025 and has applied since 8 January 2026. For products whose harmonised specification still sits under the old law, transitional rules apply. Art. 94 repeals the remaining articles of the old Regulation with effect from 8 January 2040. The Commission’s page says 2039.
The declaration of performance and conformity replaces the declaration of performance one year after the implementing act that makes the new specification binding for your product family, or later if the act says so (Art. 95(9)). Until then your current declaration stays the one that counts.
Providing it electronically: what matters
Under Article 16(1) of the Regulation, electronic provision is the default. For the declaration of performance under the previous law, Delegated Regulation (EU) No 157/2014 sets the conditions for a website: unchanged, free of charge, linked to the product through its identification code, and available for at least ten years. In practice this works well:
- A fixed address per product type that never changes (QR code on label or packaging)
- The document as an unchangeable PDF; a new version is a new file and the old one stays retrievable
- The unique identification code of the product type on product and declaration
- Free access without registration

And the safety data sheet?
Many construction products, such as sealants, adhesives or primers, are also mixtures under REACH. Then you need both: the declaration under the Construction Products Regulation and the safety data sheet under REACH. Each document has its own rules on how it must be provided.

Frequently asked questions
Does my current declaration of performance remain valid?
For products whose harmonised specification still falls under the old Regulation, the declaration of performance remains the relevant document for now. The switch happens product family by product family, one year after the implementing act on the new specification or later (Art. 95(9)).
Do I still have to supply the declaration on paper?
No, electronic is the default (Art. 16(1)). End users get paper free of charge on request at purchase (Art. 91(2)). Under the old law the recipient gets paper on request (Art. 7(2) Regulation 305/2011).
When does the product passport for construction products arrive?
Through a delegated act whose date the Commission has not set. The duty applies 18 months after the act (Art. 22(7), Art. 80(1)).
